View Full Version : Hypothetical, what should be a felony.

Scenario one: a group of teenagers are riding around, the come upon a stop sign with a car sitting at it. As a prank, one of the teens throws a food item at the car. The driver of the stopped car calls the cops and the teen thrower is arrested. No one is hurt.

Scenario two: A ten year old boy and his six year old brother play a prank. The ten year old boy tells the police that his six year old brother was in a hot air balloon that got untied. The media covers said event for two hours, only to discover that said event was a hoax. No one is injured.


Either of these deserve a felony charge? If so which? Or do both? Or neither?

And remember, these ARE hypothetical.

1) Felony, there are still moving cars on the intersection. Though if there are no prior, I'd give probation with a conditional sentence.

2) Charge the parents, as I'm sure they were involved.

If it's hypothetical, then no, the kids shouldn't be charged, as they are under they age of criminal culpability and don't know better. The teens in the car aren't and do know better.

At what age do we make that distinction. I would think it would be different on a person by person basis

I say make them both felonies.

Scenario 1: It shouldn't be a felony, but I understand why it is in some states.

Scenario 2: No felony for the 6 year old and probably not for the 10 year old either. A 6 year old cannot posses the mens rea necessary for a crime - - - I have my doubts if a 10 year old can, but thats debatable.
