When 9/11 mastermind Khalid Sheikh Mohammad was captured on March 1, 2003, he was not cooperative. “I’ll talk to you guys after I get to New York and see my lawyer,” he said, according to former CIA Director George Tenet.

Of course, KSM did not get a lawyer until months later, after his interrogation was completed, and Tenet says that the information the CIA obtained from him disrupted plots and saved lives. “I believe none of these successes would have happened if we had had to treat KSM like a white-collar criminal – read him his Miranda rights and get him a lawyer who surely would have insisted that his client simply shut up,” Tenet wrote in his memoirs.

I don't get it. A soldier was not considered a criminal if captured on the battlefield. This is setting very bad precedent.Very bad...
If captured they where held as POWs until the wars end and then repatriated to their home country of origin or allegiance... There was no Miranda necessary since there was no crime committed. A captured soldier killing the last man to be killed on the last day of the war was released after the end to war the same as the guy caught on the first day of the war and having killed no one..

If there was thought to be a crime committed in the discharge of the soldiers duty then a trial was held to decide if a crime was even committed.

I understand the uniform and recognition problem or lack there of and the unusual problem it presents but thats what the enemy combatant process addressed rather than shooting/hanging these guys as spies or infiltrators..like we did in the past..

Very bad precedent and I believe we will rue the day with great penitence we started doing this.. Anyone thinking this is the "last" war is drinking fairy dust kool-aid.. There will be wars and there will be captured soldiers as POWs on both sides including ours..

bush the idiot set a very bad precedent That is what will happen if you Miranda soldiers and give everyone in war a war crimes status. THat is what Mikranda essentially does. Accuse you of a crime and gives you certain rights to defend yourself.. Fighting on the battle field is not a crime.. naver has been since history but we (your idiot boy Ombama) is making it one now.....

Obama is setting a worse one IMO. In this case.
